By accessing or using the AutoFit platform, mobile applications, AutoFit Portal devices, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and AUTO FIT AI LTD, a company registered in England & Wales (Company No. [Registration No.]), with its registered office at 80A Ruskin Avenue, Welling, DA16 3QQ, United Kingdom.

You must be at least 16 years of age to use the Service. Users between 16 and 18 require verifiable parental or guardian consent to use features involving biometric data collection. By using the Service, you represent that you meet these eligibility requirements.

AutoFit provides an AI-powered movement intelligence platform that includes: • Real-time skeletal and postural tracking via computer vision (no wearables required). • AI-generated workout programmes, coaching cues, and form correction. • Biometric safety monitoring including joint stress detection. • Arabic and multilingual voice coaching. • Nutrition planning and macro tracking. • Operator management tools for gym owners and fitness facilities. • Investor and partner information portals. The Service operates through AutoFit Portal hardware devices installed in physical fitness facilities, mobile applications, and web interfaces.

To access certain features, you must create an account. You agree to: • Provide accurate, complete, and current information during registration. • Maintain the security of your account credentials. • Notify us immediately of any unauthorised access to your account. • Accept responsibility for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in prohibited conduct.

IMPORTANT: The AutoFit Service is designed for general fitness and wellness purposes only. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. • AI coaching cues, form corrections, and biometric alerts are informational only and do not replace professional medical or physiotherapy advice. • Injury-risk alerts and joint stress scores are algorithmic estimations — they are not clinical assessments. • Always consult a qualified healthcare professional before starting any exercise programme, especially if you have pre-existing medical conditions, injuries, or disabilities. • AutoFit is not responsible for injuries, adverse health events, or outcomes resulting from following AI-generated recommendations.

Physical exercise involves inherent risks. By using the Service, you acknowledge: • You voluntarily participate in physical activities and assume all associated risks. • You are physically capable of performing the exercises recommended. • You will listen to your body and stop exercising if you experience pain, dizziness, shortness of breath, or other symptoms. • Results vary between individuals. AutoFit makes no guarantees of specific fitness outcomes. • Nutrition plans generated by the AI are general guidance only and not personalised medical nutrition therapy.

You may use the Service solely for lawful personal or business fitness purposes. You agree NOT to: • Reverse-engineer, decompile, or attempt to extract source code from AutoFit software or AI models. • Use automated tools, bots, or scrapers to extract data from the Service. • Reproduce, redistribute, or resell AutoFit content or data without written permission. • Attempt to circumvent security measures or access restricted systems. • Use the Service for surveillance, data harvesting, or any purpose that violates applicable law. • Misrepresent your identity or affiliation with AutoFit.

All content, software, AI models, trademarks, logos, designs, and technology comprising the AutoFit Service are the exclusive property of AUTO FIT AI LTD or its licensors. Nothing in these Terms grants you any intellectual property rights beyond a limited, non-exclusive licence to use the Service as intended. User-generated content (such as workout logs and profile information) remains your property, but you grant AutoFit a worldwide, royalty-free licence to use such content to provide and improve the Service.

Certain features of the Service require a paid subscription or one-time purchase: • Subscription fees are billed in advance on a monthly or annual basis. • Prices are displayed in the applicable currency at the time of purchase. • Subscriptions auto-renew unless cancelled before the renewal date. • Refunds are provided in accordance with applicable consumer protection law. Contact billing@autofit.ai for refund requests. • We reserve the right to modify pricing with 30 days' advance notice.

If you deploy AutoFit Portal devices in a fitness facility as a gym operator or partner: • You are responsible for ensuring your use of the Service complies with applicable data protection laws and obtaining necessary consents from your members. • You may not sublicense, resell, or transfer your operator licence without our written consent. • You agree to provide accurate information about your facility, usage, and member count. • Operator agreements are governed by separate partnership contracts in addition to these Terms.

When you access AutoFit via the Apple App Store or Google Play Store: • Apple App Store: These Terms supplement (and do not replace) Apple's standard Licensed Application End User License Agreement (LAEULA). Apple is not responsible for the Service or any claims related to it. • Google Play Store: Your use is subject to Google's Terms of Service in addition to these Terms. • Both Apple and Google are third-party beneficiaries of these Terms and may enforce them against you. In-app purchases are subject to the respective app store's payment and refund policies.

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: • AUTO FIT AI LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. Some jurisdictions do not allow limitations on certain warranties or liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless AUTO FIT AI LTD and its affiliates, officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit to the Service.

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. For users in the EEA or UK, mandatory consumer protection rights under applicable local law are not affected by this choice of law. Any disputes arising from these Terms or the Service shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to the courts of England and Wales, or to any alternative dispute resolution mechanism mutually agreed upon by the parties.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
